We have obtained a not guilty outcome for one of our clients who was charged with violation of order of protection. The criminal complaint charged our client with knowingly violating a valid order of protection by failing to stay away from his former wife.
During a bench trial, one of our attorneys successfully cross-examined our client’s former wife (who was also the complaining witness). Upon close of the State’s case, our attorney moved for a directed finding, arguing that the State failed to prove it’s case against our client. Based in part on our attorney’s cross-examination, the trial court agreed with our attorney and found that the State failed to prove it’s case and found our client not guilty of the charges against him.
